Anyway, about the 14th amendment, most people are under the mistaken impression that the marriage issue is a religious one. It's not. It's a legal one. If it were something else all the talk about making laws about it would be stupid - see. Marriage is a legal issue. So since it's a legal issue and since the Constitution guarantees all citizens the right to expect equal treatment under the law, it follows that gay people are just as entitled to be recognized as married couples by the state as straight people. The state does not have the authority to deny gay people legal recognition (a license) of marriage unless the same denial could be applied to straight people, or handicapped people, or Democrats or etc ...
