Now that I'm thinking of them, the question to be asked is; What will HELLER do in re swords? In the MILLER Ruling, the Supremes mentioned that part of the normal kit for militiamen was swords & "hangers" (which is a small sword chiefly used by seamen). The Court also mentioned that each man was expected to bring his own arms. The DC Circuit ruled that a revolver is the linear descendant of a flintlock pistol & so enjoys the same protection as all other descendants of Revolutionary Era items protected by the BoR. Examples: the typewriter is the linear descendant of a quill pen, & so is covered by the 1st. Amendment. A blog is the linear descendant of Tommy Paine's pamphlets & so is also protected by the 1st. But a sword is a sword is a sword. No issues of descendants here. If the Supremes do rule that the 2nd. means just what it says, will I be allowed to carry a sword as in days of old? I have a lovely custom-made rapier that I think would be the perfect accessory for walking about. "Boris" could carry his samurai sword. Knives aren't mentioned, but bayonets are. Modern bayonets are knife/bayonet combos, so would I be limited in the type of knife I could carry? Would it have to have the ring that allows fitment on the barrel of my rifle to be legal? Or, is a knife just another "arm" that citizens would once again be permitted to carry? Just musings. Sean |
